Frequently Asked Questions
Will my information be safe and available when I need it?
Yes. All sessions between you and ConXPoint are conducted over a secure SSL
128-bit connection, the same process used by banks for online transactions. SSL
is designed to prevent anyone listening in on or viewing your session or
accessing your information, unless you specifically authorize
them to do so. Your documents and data are stored in a secured database located
in our Class 1 data center whose security procedures are audited by external
auditors in accordance with the requirements for SAS Type II certification.
Your data is backed up daily onsite, as well as offsite. In the unlikely event
of service failure, we have rapid response data recovery procedures to return
the service to normal operational status quickly and efficiently.
Frequently Asked Questions
What about the legality of Electronic Transactions?
Both US Federal and state law provide for the legality of electronic records and
electronic signatures, as well as the laws of many other countries. No one is required
to use electronic signature and records - it is entirely voluntary. However
there are often considerable cost and time savings in doing so. There are only
a few transactions that are not allowed to be done electronically, such as
wills and durable medical powers of attorney. In addition, many government
agencies already accept electronic signatures, such as the IRS. If you
would like detailed information on such laws, we recommend contacting the following person who is one of the nation's leading authorities on the matter:

Frequently Asked Questions
Are Electronic Signatures reliable and enforceable?
U.S. Federal and state laws prohibit discrimination against electronic
signatures solely because they are in electronic form, which many people view
as making them equivalent to handwritten signatures. We all are used to writing
our names with ink to serve as our signatures, but many other methods have been
used in the past. These included wax seals, stamps or chops, and stone
carvings. The legal idea is to "make your mark" to signify your agreement with
or acknowledgement of what appears in a document. Electronic signatures just
extend this ability to the digital age, allowing you to "make your mark" by
using a variety of computer generated methods to represent your signature and,
therefore, your assent to the subject matter of the document you are signing.
These techniques, combined with robust security to protect documents from
alteration and full audit trails verifying document history and authenticity,
provide the evidentiary basis for enforceability.
